Terms and Conditions

This Agreement is concluded between S.C. Innovation Crafters S.R.L. and any User of the Seenya application, whether a physical or legal person. The present provisions establish the Terms and Conditions that govern our relationship with Users and in which we provide our Services.

Terms

Seenya and Seenya app - are commercial names belonging to S.C. Innovation Crafters S.R.L, a Romanian legal entity, with its registered office in Craiova, street AI Cuza no. 9, bl. 156 apt. Sc. 7 ap. 8 Craiova, Dolj county, having order number in the Trade Register J16/1524/2023, tax identification number 48485563.

Seenya - hereinafter referred to as the Application or Platform - is a mobile-type software program made available by S.C. Innovation Crafters S.R.L to physical persons or companies for the purpose of facilitating online socialization and/or marketing of goods or services to users. The Application is currently provided in English, and in the future, there will be possibilities for automatic translation into multiple international circulation languages of the terms used within it.

Seenya.app - also referred to as the Site represents the Seenya app's presentation web page hosted at the address www.seenya.app

Administrators - or the Seenya Team represents the employees or representatives of S.C. Innovation Crafters S.R.L with responsibilities in managing the app, user accounts, and services provided to users.

User - any individual over the age of 18 or registered legal entity in the Seenya app who, by initiating the Account creation process, has given consent to the specific clauses in the Terms and Conditions section. The user has free access to the app's free services or can choose to become a VIP User based on a Subscription. The free User account is conditioned by the periodic presence of adds-type commercial communications.

Services - the computer activities allowed to users in the app such as: creating an account, uploading personal photos to their own account, displaying personal text information and/or personal social media links, signaling to other users that they want to interact with them, the possibility of sending and receiving messages to/from other users.

Sign up - represents the process of creating an account by entering a personal photo, username or pseudonym, date of birth, gender, search preferences based on gender, and an email address to which an authentication code will be sent.

Subscription - represents the cost-based activation of a VIP account. The terms and conditions related to the subscription, suspending subscription or reimbursing account belongs to the payment gateway operated by Google Play or Apple Pay and can be found here https://play.google.com/about/play-terms/index.html and https://www.apple.com/shop/help/payments

Username - a name or pseudonym associated with a User through which they are identified in the app and under which they can post media content such as text, photos or send messages to other users.

Account - a section of the app consisting of User identifiers such as the Username, email, photo, and any other optional data that allow the connection to the app and the representation of the User within it and to other users. The app does not condition access or use on the introduction of real data, their authenticity is the user's option. However, it is forbidden to use data identifiable as belonging to other persons, in which case the account will be deleted and access blocked following complaints and verification.

Confirmation code - represents a numeric code sent by the Seenya app to the email address used by the User in the Sign Up process to confirm the authenticity of the email address and complete the creation of the Account.

Content - represents the total of text or multimedia data published by Seenya and which can be visited/viewed or accessed through the use of an electronic device.

Notification - represents a text and/or multimedia message communicated by the Seenya platform within the application to the User.

Commercial communications - represents any type of message (e-mail/mobile push/webpush) containing information about their own products, changes, improvements, offers, events, surveys, and any other information of an informative or commercial nature transmitted within the application or at the email address registered by the User by the company or its partners.

Adds – any commercial advertising like txt, images or videos delivered within the app to the free accounts by the commercials partners of S.C. Innovation Crafters S.R.L.

Terms of Use

By registering on the Seenya Platform, you agree to respect this User Agreement throughout the use of the Services offered by this application as a User.

This User Agreement has the value of a contract between S.C. Innovation Crafters SRL and the User, with all legal consequences arising from this. If you do not wish to fully assume this User Agreement, do not access or use our Services in any way. If you wish to terminate this User Agreement, you can close your account at any time and stop accessing or using our Services. Enrollment and use of services implies full acceptance by you of these Terms and Conditions. At the time of enrolling in the application, the User assumes that the data provided belongs to them and is real, otherwise they are subject to legal provisions regarding identity theft.

In situations where we face a case of identity theft, we will support any kind of investigations, inquiries or research by state authorities and will provide information to Prosecutors, Police, courts of law and other authorized state bodies, based on and within the limits of legal provisions in response to express requests.

Changes to the User Agreement

We reserve the right to modify this User Agreement, Privacy Policy or Cookies Policy at any time and in any way, as well as the appearance, options or features of the application. Any substantial changes will be announced through the application's notification service. Continuation of use of our Services, after the publication or sending of an announcement regarding the changes made to them, confirms your agreement with the implemented changes.

Use of the Application: Registration

By becoming a User, you support and guarantee that you are at least 18 years old and understand and fully accept the terms of use of the services offered by the Seenya team. However, we cannot guarantee that each User is within the age limit. We are not responsible for the use of the application by minors who have violated this Agreement.

In case the information provided by you is found to be false or belonging to someone else, we reserve the right to terminate this User Agreement and to prohibit you from accessing the Services.

All sensitive information that you provide us when creating your account and/or later by editing your profile, as well as private messages between users, are confidential, encrypted, and will not be disclosed to any third party, except in cases where the law requires it. For details on the processing of personal data, please refer to our Privacy Policy.

Account

When creating your account, you will be asked to choose a Username. We reserve the right to reject any account name that:

  • May cause confusion;
  • May offend any person, entity or group in any way
  • May be interpreted as obscene;
  • Contains advertising references to illegal activities.

You can cancel your account anytime and for any reason, and in turn, we have the right to prohibit access anytime and for any reason without prior warning. Your account is personalized and secured by an activation code sent to the email address used when creating the account. Therefore, it is important to provide a valid and real email address. Additionally, by this Agreement, you agree not to transfer or sell access to the application to other physical or legal persons through your account. You are solely responsible for the security of your account and for any activities carried out within the application.

To ensure the security and quality of the services we offer, we reserve the right to delete the accounts of free Users who have not used our services for a minimum of 6 months.

Online Conduct

By becoming a User, you agree that:

  • You will respect all applicable laws, including, without limitation, privacy laws, intellectual property laws, tax laws;
  • The information provided is real and belongs to you; You will not create a false identity, you will not present your identity inaccurately, you will not create a member profile for anyone other than yourself (a real person), you will not use or attempt to use another User's account;
  • You are solely and directly responsible for the content of the information entered in the app, including any information that you post in your profile or send to other users;
  • You will not use the app to harm, harass, threaten or offend any person, entity or group in any way;
  • You will not use the app to send unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, or any other form of commercial solicitations;
  • You will not use the application to disseminate political, religious propaganda against minorities or communities of any kind, or any other form of propaganda.
  • You will not use or transmit to other users materials and/or messages that are obscene, offensive, aggressive, discriminatory, defamatory, threatening, profane, illegal, sexually explicit, or any other materials and/or messages that in any way infringe upon the rights of the parties involved.
  • You will not modify, copy, translate, sell, adapt any material or part of this site, regardless of the purpose.
  • You will not upload, distribute, or reproduce copyrighted materials, trademarks, or other information from the site or app without prior consent from the owner.
  • You are solely responsible for your relationships with other Users. The Customer Support Team reserves the right, but not the obligation, to monitor any disputes between Users if there is a legal obligation to do so or if a User reports an abuse.

Online Conduct Violation

In case the User breaches one or more provisions of this User Agreement or if there are indications of breach of provisions of this User Agreement, or if the User creates a risk or potential legal exposure for the Seenya team, the Administrators reserve the right to apply warnings or other sanctions, in any manner, at their own discretion.

Administrators can apply, after analyzing complaints from users or at the request of any authority, without being obliged to justify their action in any way, without being obliged to comply with any other formalities, and without being obliged to justify the reasons, any of the following measures against Users who breach the provisions of this User Agreement: issuing warnings; suspending the account in full or in part; restricting access to the account/sections of the account; cancelling the User's account, applying fees for lifting restrictions.

Persons whose account or access to our services has been suspended, restricted, withdrawn, or prohibited for any reason, as well as persons who have breached any provisions of this Agreement in any way, no longer have the right to use our services.

In case the account is suspended for violating online conduct or any provisions of this Agreement, the amounts paid for the period during which the User had the suspended account will not be refunded, regardless of the service paid for, the subscription may be used after the account is reactivated, until the end of the paid period.

To maintain a safe communication and interaction environment, all Users are invited to use the Contact option within the application (the option can be found in the Settings page) whenever they consider that the site's conduct rules are being breached. The User assumes and understands that part of the reported conversation will be checked by Administrators.

Identity Theft Procedure

We would like to inform you that the theft of personal data is a crime that is punished under applicable law.

By filling out the registration form on the site, accepting the Terms and Conditions and Privacy Policy, each User declares and guarantees that the information provided is real and assumes the legal consequences arising from providing false information.

The Seenya team will ensure our full availability in case you are aware of an identity theft and we will cooperate with the state authorities empowered to resolve such requests, if necessary.

In case you find that a User of the service is stealing your identity, stealing the identity of a friend or are the legal representative of the person whose identity has been stolen, please contact us at the email address contact@seenya.app or through the Contact service within the application.

To prevent fraudulent or malicious removal requests that seek to remove real information without having this right, we must verify the identity of the person reporting the identity theft, for which we will request a copy of an identity document (passport or ID card) in which your photo, name, and surname can be identified, along with a few other relevant photos of you, different from those appearing in the application, from which your identity can be confirmed.

You can cover certain information in the ID card (e.g. series and number, CNP, address, etc.) provided that your name, surname and photo remain visible. In case the account you claim is false is not using your identity but that of a friend, it is necessary for the person whose data was stolen to send us the identity verification request along with the proof documents.

Free Services

After creating the account, the User will receive the basic services for an indefinite period of time for free, which do not allow access to all the features of the application. The full features can be found in the application on the subscription presentation page.

The User may choose to purchase a subscription that includes these additional features, as specified in the subscription presentation page. If the User chooses a subscription after a promotion or special offer, the price and special conditions of the campaign may no longer be available in the future.

The User may at any time unsubscribe from the chosen subscription, subject to the conditions of this Agreement. After purchasing a subscription, it will begin its validity period immediately after payment confirmation by the payment processor. The subscription rates are clearly stated within the presentation page, in Euros. The rates are specified for each subscription and include VAT.

Limitations of Liability

The Seenya team cannot be considered responsible for any frauds caused by the User.

  • The User is solely responsible for maintaining full confidentiality of the data regarding the Seenya account. The team cannot be held responsible for damages caused by the disclosure of authentication data
  • Unsecuring the work environment during transactions - using a virus-infected smartphone or one that runs spyware, malware, keyloggers and any other categories of mobile computer viruses
  • Making payments by card/sms/online payment services/cryptocurrencies to a third party, a physical or legal user or non-user of the Seenya application.
  • Seenya does not guarantee that the service for which you have paid will be immediately available. We will do everything possible to ensure the good functioning of the application but for various reasons - technical problems, problems with internet connection, a service may be unavailable for a period of time. From the moment of remedying any problems that may arise, the service will be provided for the contracted period.

Copyright Policy

All Users must respect the property and privacy rights of other Users. By introducing content in the application, you guarantee that you have ownership of it or have approval from the owner for its use in accordance with the Terms and Conditions of use.

The SeenYa Administrators do not claim ownership of the content that Users assume or post.

You agree to grant the Seenya Team free, unlimited and on all territories, the right to use the materials, from the moment they are transmitted to the application, including copying, distributing, transmitting, publishing in any media format and through any media channels, reproducing, modifying and translating, mentioning your name in connection with the material you transmitted and the right to assign, free or at a cost, all these rights to any platform partner.

To resolve any complaints regarding the services provided within Seenya, please contact our customer support team at the email address contact@seenya.app.

Applicable Law, Disputes

The rights and obligations of Users and the Site Administrators, as provided in the Terms and Conditions of Use, and all legal effects produced by them, shall be interpreted and governed in accordance with the Romanian law in force.

Any dispute arising from or in connection with the Terms and Conditions shall be resolved amicably. In the event of an inability to reach an agreement, the dispute shall be resolved by the competent Romanian court located in the territorial area of the city of Craiova.

General Provisions

Compliance with this Agreement is mandatory for all Users without exception. Any breach of the Agreement is subject to our decision and may lead to the cancellation of the account and the ban on accessing the application at any time. Each User certifies that he/she has read this User Agreement and agrees to fully respect the Terms and Conditions thereof.

Who we are

In the sense of the data protection legislation, we are the data controller when we process your personal data. Ensuring the right to data protection is a priority for us, which is why your data will be processed in full compliance with Regulation (EU) 2016/679 (the "General Data Protection Regulation" or "GDPR"), as well as with any other applicable legislation in Romania.

In order to ensure transparency, we would like to inform you about how we collect, use, transfer, and protect your personal data when you interact with us in relation to our products and services, including through our website or through mobile applications such as SeenYa.

Additionally, for any questions, we encourage you to contact the Data Protection Officer at the email address contact@seenya.app. We reserve the right to periodically update and modify this Privacy Policy in the event of changes to the way we process your personal data or any changes to legal requirements. What categories of personal data do we process

Generally, we collect your personal data directly from you, so that you have control over the type of information you provide us with.

We receive information from you as follows:

When you create an account in the SeenYa application, you provide us with: photo, username/nickname, date of birth, gender, email address.

When you use the SeenYa application, you provide us with additional data necessary for its operation, such as location data and the ID of the mobile device used (token). We also give you the option of displaying, optionally, in your profile in the application links to your profiles in other social media applications such as Facebook or LinkedIn.

We mention that we will never request login information in these third-party applications, and the security and/or personal data processing policies in those applications exceed our obligations.

Processing purposes

We process your personal data for the following purposes:

  • To provide you with the services and products you have requested, such as creating and managing your account, providing location-based services, and sending notifications.
  • To improve and optimize our services, including the SeenYa application, and to ensure their proper functioning.
  • To send you marketing communications, in accordance with your preferences and only if you have given us your consent.
  • To comply with legal obligations, such as tax reporting, etc.
  • For the detection and prevention of fraud, abuse, and security incidents.
  • For the exercise or defense of legal claims.

For how long will we retain your personal data

We will retain your personal data for as long as necessary to achieve the purposes for which it was collected, in accordance with this Privacy Policy and in accordance with applicable law. Once the purpose for which the personal data was collected has been achieved, or if you have requested the deletion of your account, we will delete your personal data, unless there are legal obligations or legitimate interests that require us to retain it for a longer period of time.

Who do we share your personal data with

We may share your personal data with third parties as follows:

  • marketing service providers;
  • market research service providers;
  • other companies with whom we can develop joint marketing programs for our goods and services.

In case of legal obligations or if it is necessary to defend a legitimate interest, we may also disclose certain personal data to public authorities. Access to your data by private legal entities is carried out in accordance with the legal provisions on data protection and confidentiality of information, based on contracts concluded with them.

In which countries we transfer your personal data

Your personal data is stored and processed within the European Union and the European Economic Area (EEA).

In the event that your personal data will be transferred outside the European Union or EEA, the transfer will be carried out (a) on the basis of a decision of the European Commission deciding that the third country in question provides an adequate level of protection, (b) on the basis of mandatory corporate rules, or (c) on the basis of standard contractual clauses adopted by the European Commission.

Additionally, in the event that we identify that one of these measures is not sufficient to ensure an adequate level of protection, on a case-by-case basis, we will adopt additional technical and/or organizational security measures in accordance with the recommendations of the European Commission.

How we protect the security of your personal data

We are committed to ensuring the security of personal data by implementing appropriate technical and organizational measures, in accordance with industry standards. The transmission of your personal data is done using state-of-the-art encryption algorithms and is stored on secure servers, while ensuring data redundancy. For payments, we use the services of the Google Pay payment processor. Any payment information is encrypted using HTTPS encryption.

Despite the measures taken to protect your personal data, please be aware that transmitting information over the Internet, in general, or through other public networks is not completely secure and there is a risk that the data may be viewed and used by unauthorized third parties. We cannot be held responsible for such vulnerabilities in systems that are not under our control.

What rights do you have

The General Data Protection Regulation recognizes a series of rights in relation to your personal data. You can request access to your data, correction of any errors in our files and/or object to the processing of your personal data. You can also exercise your right to complain to the competent supervisory authority or bring a judicial remedy.

Additionally, you may exercise your right to complain to the competent supervisory authority or address the judiciary. Depending on the case, you can also avail of your right to request the deletion of your personal data, the right to restrict processing of your data, and the right to data portability.

Important considerations when exercising your rights:

Identity: We take the confidentiality of all records containing personal data seriously. For this reason, we ask that you send us your requests regarding such records using the email address associated with your SeenYa account. Otherwise, we reserve the right to verify your identity by requesting additional information aimed at confirming your identity.
Fees: We will not charge a fee to exercise any of your rights regarding your personal data, except in the case where your request for information is unfounded, that is, repetitive or excessive, in which case we will charge a reasonable fee in such circumstances. We will inform you of any fees applied before resolving your request.
Response time: We aim to respond to any valid requests within a maximum of one month, except in the case where this is particularly complicated or if you have made multiple requests, in which case we will respond within a maximum of two months. We will let you know if we need more than a month. We may ask you to tell us exactly what you want to receive or what concerns you. This will help us to act faster and shorten the response time to your request.
Third-party rights: We do not have to comply with a request if it would negatively affect the rights and freedoms of other affected persons.

You can ask us:

  • to confirm whether we are processing your personal data;
  • to provide you with a copy of that data;

What are Cookies?

Cookies and/or similar technologies are a central aspect of the efficient functioning of the Internet, helping to generate a user-friendly and tailored browsing experience based on each user's preferences and interests.
